Terms & Conditions
In the following terms & conditions “the photographer” shall mean Danielle Trajkovski
trading as DAZE Photography.
“The client” shall be those persons defined as the contact person within the booking
form. These terms &; conditions cannot be varied in any way by the client unless such
conditions are expressly agreed by the photographer in writing.
1. COPYRIGHT
i. The copyright Designs and Patents Acts assign the copyright of the images to the
photographer.
2. DISPLAY
i. The client(s) hereby allow(s) the photographer to display any photograph covered by
this contract and to generally promote the business in advertising, brochures, magazine
articles, social media, websites, sample albums, prints etc.
3. CREATIVE LICENSE, COVERAGE AND REPRODUCTION
i. Photographs taken during the course of the photoshoot will be at the discretion of the
photographer although every effort will be made to comply
with the client’s requirements.
ii. Special requests are not binding instructions, although every effort is made to comply
with the client's wishes. The Photographer will do their best to honour the requested
photographs but do not undertake to guarantee any specific picture nor incorporate any
specific background.
4. PAYMENT TERMS
i. A non-refundable booking fee will confirm your booking, as well as full acceptance
of the terms and conditions. The booking fee will be deducted from the cost of the
client(s) chosen package when calculating the final balance due.
ii. Payment in full of the remaining balance will be required the week prior of the
photoshoot. Failure to make payment of the remaining balance may result in your
sessions being cancelled.
iii. Due to any cause beyond the clients control e.g. sudden illness, injury, vehicle
breakdown etc, then a new session date will be allocated.
5. FINAL IMAGES
i. The photographer will endeavour to deliver your hi-resolution images within 4-6 weeks
& during busy periods 6-8 weeks.
ii. Option to upgrade to full gallery for additional gallery *$150 or $15 per image
6. PHOTOSHOOT SESSION
i. Any directions issued to clients during a photographic shoot are deemed to be at
persons own risk. The photographer cannot be held responsible for any personal
accidents during a photographic shoot.
7. COVID/ CANCELLATION BY THE PHOTOGRAPHER
i. In the event of cancellation by the photographer or of total photographic failure, liability
shall be to a full refund of any fees paid.
ii. The photographer will endeavour to put the client(s) in touch with another
photographer in the event they are unable to attend the photoshoot
iii. Pending Government restrictions for a full lockdown due to Covid, a re-schedule date will be allocated.
8. DIGITAL NEGATIVE FILES
i. All digital negatives (computer files) remain the property of the photographer. All
digital lifestyle packages include a copy of the edited digital.
ii. Should the digital negative files be lost, damaged or destroyed for reasons beyond
our control, the photographer’s liability shall be limited to a
full refund of any deposits and fees paid, but shall not include a refund for any goods
already received.
9. EDITING
i. Basic editing is included in your package, if you would like additional edit
enhancement this will be an additional cost based on the type of edit required.

10. DISPLAY OF IMAGES
i. The Client is not to add a filter or screen shoot the images from the online gallery and display on social media. Please be sure to download your hi-resolution image and post to social media or website with the original editing from the Photographer, in doing so please tag and credit DAZE Photography.
